You and your spouse have separated and are living separate and apart and it is not likely that you will live together again, when you separate there are many decisions that need to be made.


You will need to arrange which one of you will care for your children, what the time sharing arrangements will be between each parent and the children, how much support will be paid and how you will divide your property.


You can resolve issues in different ways. Unless the circumstances of your separation make it unsafe to negotiate, it is usually better for the two of you to try to agree how to settle the outstanding issues between you through negotiation. Court proceedings can be very expensive and can take a long time.


If you and your spouse are able to reach an agreement, you can sign a Separation Agreement. A Separation Agreement must be signed by both of you in front of a witness for it to be binding. The witness must also sign the Agreement.
